VICOR MUSIC CORPORATION (“VMC”) values the data privacy of its users while being compliant with Republic Act No. 10173 also known as the Data Privacy Act of 2012 (“DPA”), and the relevant rules, advisories, and issuances of the National Privacy Commission in
relation to it. Thus, VMC provides below the details as to how it collects, uses, shares, and protects the data provided by its users.

PERSONAL DATA COLLECTED

Users who wish to avail of VMC’s service via the VMC Website (the “Services”) which may be
accessed through the URL, https://vivavicor.com/ (the “Website”), may do so by submitting an inquiry through the online form available on the Website.

With a submission of an inquiry using the online form, the user agrees that the following data
(hereinafter, “Data”) shall be collected from them by VMC:

Name
Email address
Mobile Number (optional)

PURPOSE FOR PROCESSING PERSONAL DATA

VMC uses the Data collected from its users for the following purposes

To provide the users with the Services;
To transact with the users in connection with their inquiry.

DISCLOSURE OF PERSONAL DATA

VMC may share the Data with its affiliates within the Viva Group of Companies and its respective service providers and/or business partners who support VMC in delivering the Services to its users.

VMC may also share the Data with law enforcement authorities if required by law or subject to a lawful order. VMC assures that the Data provided is limited to what is only required by the law or lawful order and the processing of said Data shall still be in compliance with the provisions of the DPA.

VMC may in the future also share the Data with third-party services to analyze web traffic data, engagement, and profiling of users for marketing and advertising purposes.

In your use of the Website, please note that the following information may also be gathered by third-party services (such as internet service providers) in accordance with their own policies and are not within the control of VMC: IP Address, device used and their respective OS, age, gender, location.

PROTECTION OF PERSONAL DATA

VMC values the Data of its users, and as such, VMC has put in place reasonably adequate organizational, physical, and security safeguards based on industry standards to ensure that the Data is protected against any accidental or unlawful, destruction, alteration, and disclosure, as well as against any other unlawful processing. Such safeguards are specifically chosen owing to the nature of the Data and the risks involved in its processing.
VMC also requires its affiliates within the Viva Group of Companies and its respective service providers and/or business partners to employ the same measures in protecting the Data. Lastly, VMC also assures its users that its employees, agents and representatives who are
involved in the processing of Data hold such under strict confidentiality and are not intended for public disclosure.

RETENTION OF DATA COLLECTED

VMC may continue to retain the Data for as long as the purposes for which they were collected remain to exist subject to applicable laws and regulations.

YOUR RIGHTS AS A DATA SUBJECT

Under the Data Privacy Act of 2012, users have the right to be informed of the Data collected and the processing of such. Users also have the right to request the following from VMC:

Access to Data about the user which VMC processes;
Correction or rectification of their Data should such Data be determined to be inaccurate or incomplete;
To delete their Data or block VMC from collecting their Data;
Object to the processing of their Data unless such processing is based on a legitimate interest as allowed under the DPA; and
Request for data portability or receive a copy of the user’s Data which the user can move, copy, or transfer securely for further use.

Should you have any concerns, you may send them to the Data Privacy Officer of VMC through the email address dataprotectionvicor@viva.com.ph for prompt action. In the alternative, the same may be sent directly to the National Privacy Commission.

VMC may amend or revise the foregoing privacy notice from time to time in order to comply with any changes in the applicable laws, rules, and other issuances. We assure our users that such updates shall be posted on our websites.
